Ashley Judd"s Sexual Harrassment Claim Against Harvey Weinstein Dismissed by Judge

Ashley Judd‘s sexual harassment claim against Harvey Weinstein was dismissed in court on Wednesday (January 9), according to TMZ. The 50-year-old actress claimed that the 66-year-old movie producer kept her from a role in Lord of the Rings, and then blacklisted her from further movie roles, after she refused his sexual advances. She sued Harvey under the legal theory “sexual harassment in professional relationship.” The judge ruled that Ashley and Harvey‘s relationship did not fall within that law and that a producer-actress relationship is not covered under that law. While the law was changed in 2018 to cover that kind of relationship, the judge also ruled it could not be applied retroactively. However, she can still litigate her defamation claim. Harvey Weinstein Responds to Ashley Judd Defamation Lawsuit

The 50-year-old actress – who was one of the first to come forward when the 66-year-old disgraced producer‘s scandal came to light – says that Harvey smeared her reputation to Lord of the Rings director Peter Jackson, leading him to not cast her. Ashley is seeking damages for defamation, sexual harassment, and violations of California’s unfair business competition law. After the suit was filed, a representative of Harvey‘s had this to say on the disgraced producer’s behalf: “The most basic investigation of the facts will reveal that Mr. Weinstein neither defamed Ms. Judd nor ever interfered with Ms. Judd’s career, and instead not only championed her work but also repeatedly approved her casting for two of his movies over the next decade,” THR reports. “The actual facts will show that Mr. Weinstein was widely known for having fought for Ms. Judd as his first choice for the lead role in Good Will Hunting and, in fact, arranged for Ms. Judd to fly to New York to be considered for the role. Thereafter, Ms. Judd was hired for not one, but two of Mr. Weinstein’s movies, Frida in 2002 and Crossing Over with Harrison Ford in 2009. We look forward to a vigorous defense of these claims.”.....»»

The 65-year-old movie producer spoke with The Post after the claims against him were made and says that he “bears responsibility” for his past bad behavior and explains why he plans on suing The New York Times for running the “false” story. “What I am saying is that I bear responsibility for my actions, but the reason I am suing is because of the Times’ inability to be honest with me, and their reckless reporting. They told me lies. They made assumptions, Harvey said. “They spent six months researching this article then they gave us just 24 hours to answer it. They did tell us that Ashley Judd was on record, but we thought it would be along the lines of what she told Variety.” Harvey continued: “But she changed her story when giving it to the Times. I know Ashley Judd is going through a tough time right now, I read her book [her memoir “All That Is Bitter and Sweet”], in which she talks about being the victim of sexual abuse and depression as a child. Her life story was brutal, and I have to respect her. In a year from now I am going to reach out to her.” Ashley spoke with the Times and said that Harvey once invited him to his hotel room and asked her to massage him and watch him shower. “I never laid a glove on her,” Harvey says. “After this supposed incident, which she says was in 1997 while filming Kiss The Girls, I took her to an Academy Award party where we were photographed smiling. She claimed to the Times she never worked with me again. She did two movies with me — Frida, which came out in 2002, and Crossing Over with Harrison Ford, released in 2009.”.....»»

Ashley Judd Condemns "Binary Thinking" Following Unexpected James Franco Praise

As we previously reported, the industry vet shocked many when she applauded The Disaster Artist's response to recent sexual misconduct allegations. In a chat with BBC's HARDtalk, Miz Judd dubbed Franco's statement as "terrific." Related: Jamie Lee Curtis Vocalizes Support For Eliza Dushku This stunned several people as Ashley has been lauded as a silence breaker for publicly sharing her unsavory experience with Harvey Weinstein. Not to mention, the 49-year-old can be credited for contributing to the #MeToo and Time's Up movements. In response to the criticism she's received for speaking in favor of the Freaks & Geeks alum, the Double Jeopardy actress has penned an insightful letter about "binary thinking" amid this revolutionary time. Ashley started off her letter by penning: "Binary, dualist thinking misleads us. It lies to us. It tells us (most often convincingly), that to be, for one thing, we must be against another. In this case, to support survivors passionately, as I do, one must blanket condemn alleged abusers." Judd went on to explain to readers that people are allowed to both condemn abuse, while also hoping for change in the alleged predators. She continued: "We can believe folks who have been assaulted; we can condemn the unacceptable behavior, and create space for abusers to make authentic changes, amends, restitution, and ultimately to become of service to the movement toward the elimination of toxic masculinity and the fulmination of gender equity." In regards to her specific comments about James, Ashley noted that she completely believes the women who've accused the A-lister. In fact, the El Lay native declared that they have her "unequivocal, fierce support, and love." She further explained that her praise came before she understood the extent of the claims brought against Franco. Judd added: "I also believe that elements of his statement are hopeful (not the entire statement), specifically his expressed desire to set right all harms done and to make restitution. Time will tell if he does these things. I like that he said them. That is what I meant when I said 'terrific.' And of course, words are meaningless without action; Only time will tell if he makes this right." Excellent point. Ashley also suggested that men won't have the ability to change if we don't give them the chance to grow. The actress turned activist noted: "...when someone is wrong, we want them to stay wrong so that we can stay right. That is the binary that precludes space for people to change and for men (not just Franco, and not only men) to take an in-depth and moral inventory of themselves. Also, to do the work to make their unacceptable behavior something both of the past and that is redeemed for something that can be of service to another human being." Well said. And for those who doubt Ashley's dedication to the cause, Judd expressed: "That is the spirit of what I meant. I understand all of that cannot be conveyed in fifteen seconds. If some folks are going to be quick to condemn me for wanting to give space and have hope for boys and men, that is their binary, dualistic thinking in action. ... I will first and foremost always be with victim-survivor-leaders, and I will also try to understand and support men who are willing to be accountable and change." What do YOU think? If you’ve ever seen Ashley Judd on screen, you already know that she would never go nude for a part, except in the movies Eye of the Beholder, Double Jeopardy, Bug, Normal Life, and Norma Jean and Marilyn. Besides going nude in those five movies, Judd is not about to be degraded as a piece of meat by going nude in movies, and certainly isn’t going to be evaluated on her body over her acting ability. No thank you. Never ever. Except in those five movies. Where she showed her vagina and tits. While attending the 2018 Sundance Film Festival, Judd opened up to something called Behind the Camera: Where Diversity Begins about her harrowing experience with the sexist business we call show: Well first of all, my first audition yielded a screen test and I was asked to take my shirt off. It was between another woman and me, and I said that isn’t about our acting, that’s about evaluating a pair of breasts. And the answer was not ‘no’ but ‘hell no.’ See now I wouldn’t go into acting, because I know I have the physical appeal of a butt baby between Michael Cera and another Michael Cera. And that niche has already been filled by Jesse Eisenberg. Before she got enough fillers in her face to look like she’s constantly enjoying Gushers, Judd was attractive, and was able to have a relatively successful career because of it. “Sex sells” is the Hollywood equivalent of the real estate mantra “Location location location” in terms of ubiquity, and yet the actual selling of sex – whether for box office success or “because the scene called for it” – has hit a bump in the road. An industry founded on bangable people must appear chemically castrated while continuing to feature nudity in movies. Jennifer Lawrence, who made waves in October for detailing her nude audition, stripped down for 2017’s Mother! Now that she’s part of the woke club, Judd must reflect on her career with rape-tinted glasses, and in addition to condemning the need for her to show the goods before collecting her money, she gets into some Old Testament tirade in the interview that I honestly don’t even know how to respond to: I have to know the hill on which I’m willing to die. And the hill on which I’m willing to die is equality, and if that means going to jail, being maligned, being defamed, having tremendous economic loss because I stood up to Harvey Weinstein — and it’s incalculable the amount of money I could have made that I didn’t — that’s the hill on which I’m willing to die. See Ashley Judd’s tits and vag HERE and HERE!!!! Photo Credit: Splash News / Backgrid USA The post Ashley Judd Denied Part Because She Wouldn’t Show Her Juicy Tits appeared first on wwtdd......»»

Following the explosive New York Times exposé which detailed the indie movie mogul's decades of sexual harassment, several women have come forward to discuss their unsavory experiences with Weinstein. One of the latest people to speak out is model Zoe Brock. Related: Nelly Responds To Sexual Assault Arrest It's been 20 years since Miz Brock's encounter with Harvey, but she clearly remembers how he allegedly lured her back to his hotel room and begged for a massage. Now, if you read the Times coverage, you know that was Weinstein's total M.O. Per Zoe's Medium post, she was only 23 years old when she was "Harveyed." Apparently, the New Zealand-born beauty met Weinstein in 1997 while they were both at the Cannes Film Festival. She revealed: "I met Harvey Weinstein in Cannes at the Film Festival. We were seated next to each other at a fancy dinner. I didn't catch his name and assumed I was talking to another hungry producer trying to sell a little movie to the big wigs. Feeling sorry for him, I went out of my way to be entertaining and nice. It wasn't until later in the meal that I asked the name of his production company." After learning that they had a mutual friend in common, the two industry professionals spent some time together at the film festival. Zoe continued: "With a dear mutual friend in common I felt safe with Harvey. The night was young and so was I. After dinner our large group, which included my Italian modeling agent, a few rich douchebags, some decorative models, and Harvey's entourage, rolled out into the Cannes night. Black town cars and gleaming limos took us to various parties where we glittered and shone like everyone else. Harvey and his assistant, Ben Silverman, never left my side." While the conversation between Zoe and Harvey could've been misconstrued as flirtatious, Brock insists that she only felt "platonic energy" for him. Which makes it so much more troubling that Weinstein and his assistant seemingly manipulated it so that she was separated from her friends: "My group was ushered into one car and I was somehow separated from them and told to get into another car with Harvey and his two friends. Stupidly, I obliged. I was told we were all going to the same place. To this day I do not know if my Italian agent was in on the ruse. My instincts tell me he was." How awful. Things only got worse for Zoe as she relayed: "The energy shifted and I became very uncomfortable... And suddenly I was alone in a remote hotel suite with Harvey fucking Weinstein. My body went into high alert. I was drunk, young, miles from home, without cash to get a cab, and no cell phone... It was time to sober up, and fast." To make matters worse, Harvey moved quickly to proposition Zoe as he was naked and asking for massage almost as soon as they were alone. The model added: "Harvey left the room, but not for long. He re-emerged naked a couple of minutes later and asked if I would give him a massage. Panicking, in shock, I remember weighing up the options and wondering how much I needed to placate him to keep myself safe. He asked if I would like a massage instead, and for a second I thought this might be a way to give him an inch without him taking a mile. I told him I was uncomfortable and that I was angry that I had been tricked into this position. He pleaded with me to let him massage me and I let him put his hands on my shoulders while my mind raced." In an attempt to escape the filmmaker, Zoe locked herself in the bathroom as Harvey pleaded with her to come out. After reprimanding Harvey through a locked door, Brock eventually emerged and found Weinstein whimpering on the bed: "Harvey, contrite, promised to cover himself and leave me alone. I came out of the bathroom and found him sitting on his bed, wearing a bathrobe, crying. 'You don't like me because I'm fat.' He whimpered." Tsk, tsk. Supposedly, the assistant tried to apologize as Zoe has claimed he told her: "'I'm so sorry,' he said. 'I want you to know that of all the girls he does this to you are the one I really felt bad about. You deserve better.'" Ben Silverman, if you're reading this, SHAME ON YOU. Smh. According to Zoe, Weinstein let her stay at his suite at the Majestic Hotel. However, after a friend warned her that Harvey would be back in the morning, the brunette fled the hotel room at 6 a.m. In an attempt to downplay the scandalous nature of their encounter, Harvey sent Zoe red roses and booked a private movie screening for her at the festival. Both presents were unwanted. Be sure to read Zoe's full account for yourself HERE. [Image via Facebook/WENN.].....»»

During her first sit-down interview, Ashley was asked questions by Diane Sawyer about if there’s hope for him. “I believe there is hope and help for everyone. It has to be the appropriate help. And there has to be a real profound understanding on the part of the sexual predator,” Ashley said. She then was asked by Diane what she would say to Harvey right now. “Her answer surprised us,” Diane‘s voice could be heard in voice over. “But she wants to make it clear that she’ll never forgive what he did to women. But something else comes from her deep faith.” “What I would say to Harvey is, ‘I love you and understand you are sick and suffering. And there is help for a guy like you, too. And it’s entirely up to you to get that help,’” Ashley said. When Diane commented on the surprising nature of that answer, Ashley responded, “It’s just who I am…It’s an easier way to roll through the air than the alternative.” .@AshleyJudd on Harvey Weinstein: “What I'd say to Harvey is I love you and I understand that you're sick…there's help for a guy like you” pic.twitter.com/3mBkJQ8uMl — Good Morning America (@GMA) October 26, 2017 Click inside to watch more from the interview… .@AshleyJudd to @DianeSawyer on Harvey Weinstein encounter: “I thought no meant no…I fought with this volley of no’s.” pic.twitter.com/2QDO0mAa2p — Good Morning America (@GMA) October 26, 2017 .@AshleyJudd on Harvey Weinstein encounter: “I don’t know that I would have been believed — and who was I to tell?” pic.twitter.com/euY5h9sQdT — Good Morning America (@GMA) October 26, 2017.....»»

Sadly, now we're hearing one from Lupita Nyong'o. Related: All 45+ Women Who Have Accused Harvey Weinstein So Far The Black Panther actress opened up in a lengthy New York Times op-ed on Thursday, in which she says she felt "a flare of rage" in learning how many women had been through what she had: "I had shelved my experience with Harvey far in the recesses of my mind, joining in the conspiracy of silence that has allowed this predator to prowl for so many years. I had felt very much alone when these things happened, and I had blamed myself for a lot of it, quite like many of the other women who have shared their stories. But now that this is being discussed openly, I have not been able to avoid the memories resurfacing. I have felt sick in the pit of my stomach." Here is her story: "I met Harvey Weinstein in 2011 at an awards ceremony in Berlin, while I was still a student at the Yale School of Drama. An intermediary introduced him to me as "the most powerful producer in Hollywood." As an aspiring actress, I was of course eager to meet people in the industry but cautious about strangers, and the intentions of men in general." She asked her dinner companions about Harvey and was given the typical response that he could be "a bully" -- which meant it was better to have him in her corner than against her. Ultimately she says he was somewhat "charming" despite his directness, and that "he didn't alarm" her at first. So when he invited her to watch a screening of a film with his family at his home in Connecticut -- near where she was living in New Haven -- she accepted. Related: Channing Tatum Cuts All Ties With The Weinstein Company His family was actually there, at least. But when they all gathered to watch the film, that's when Harvey pounced: "I settled in for the film, but about 15 minutes in, Harvey came for me, saying he wanted to show me something. I protested that I wanted to finish the film first, but he insisted I go with him, laying down the law as though I too was one of his children." In his home with his children there. Ick. "Harvey led me into a bedroom — his bedroom — and announced that he wanted to give me a massage. I thought he was joking at first. He was not. For the first time since I met him, I felt unsafe. I panicked a little and thought quickly to offer to give him one instead: It would allow me to be in control physically, to know exactly where his hands were at all times... He agreed to this and lay on the bed. I began to massage his back to buy myself time to figure out how to extricate myself from this undesirable situation. Before long he said he wanted to take off his pants. I told him not to do that and informed him that it would make me extremely uncomfortable. He got up anyway to do so and I headed for the door, saying that I was not at all comfortable with that. 'If we're not going to watch the film, I really should head back to school,' I said. I opened the door and stood by the frame. He put his shirt on and again mentioned how stubborn I was. I agreed with an easy laugh, trying to get myself out of the situation safely. I was after all on his premises, and the members of his household, the potential witnesses, were all (strategically, it seems to me now) in a soundproof room." That time, Lupita was able to leave somewhat easily enough. She says she even justified the massage request to herself, though it helped that Harvey had enticed her with the possibility of a job (on an HBO show she later found out was already off the air). But she was still uneasy with Harvey, so when he invited her to a reading of the play version of Finding Neverland, she politely refused -- until he told her she could bring anyone she wanted. She attended with two male friends. Related: Quentin Tarantino Knew Harvey 'Did A Couple Of These Things'! Nothing untoward happened the entire evening, including when a large group went out for dinner and drinks. So the next time he invited her to a screening -- this time of Madonna's film W.E. -- she accepted. "Feeling more confident about the new sense of boundaries that we had established in our last meeting, I attended the screening on my own this time. Afterward, as planned, his male assistant arranged for me to get to the Tribeca Grill, where Harvey would be joining us. I met a female assistant when I arrived there. I was expecting that it would be a group of us, as it had been for the reading, but she informed me it would just be Mr. Weinstein. She would sit with me until he arrived. She seemed on edge, but I could only imagine how stressful it was to work for a man who had so much going on." As with other stories we've heard, the assistant "immediately disappeared" after Harvey arrived. And this time he was direct: "Before the starters arrived, he announced: 'Let's cut to the chase. I have a private room upstairs where we can have the rest of our meal.' I was stunned. I told him I preferred to eat in the restaurant. He told me not to be so naïve. If I wanted to be an actress, then I had to be willing to do this sort of thing. He said he had dated Famous Actress X and Y and look where that had gotten them. I was silent for a while before I mustered up the courage to politely decline his offer. 'You have no idea what you are passing up,' he said. 'With all due respect, I would not be able to sleep at night if I did what you are asking, so I must pass,' I replied." That's when Lupita knew Harvey was through with her; she asked him if they were good and recalls his chilling response: "'I don't know about your career, but you'll be fine,' he said. It felt like both a threat and a reassurance at the same time; of what, I couldn't be sure." Lupita made a vow to herself never to work with Weinstein, a vow she kept when he tried to entice her following her Oscar win for 12 Years A Slave. Related: LAPD Opens Harvey Weinstein Rape Investigation She explains why she's telling her story now -- for all the women who are like she was: "I share all of this now because I know now what I did not know then. I was part of a growing community of women who were secretly dealing with harassment by Harvey Weinstein. But I also did not know that there was a world in which anybody would care about my experience with him. You see, I was entering into a community that Harvey Weinstein had been in, and even shaped, long before I got there. He was one of the first people I met in the industry, and he told me, "This is the way it is." And wherever I looked, everyone seemed to be bracing themselves and dealing with him, unchallenged. I did not know that things could change. I did not know that anybody wanted things to change. So my survival plan was to avoid Harvey and men like him at all costs, and I did not know that I had allies in this."
